Don is senior counsel with Prowse Barrette LLP. For more than four decades his practice has primarily focused on property rights. He has advised and advocated for rural and urban landowners, as well as for First Nations, in hundreds of expropriations, environmental and energy-related cases. He’s had many appearances before all of Alberta’s courts and administrative bodies such as the Alberta Land and Property Rights Tribunal, Alberta Utilities Commission, Alberta Energy Regulator (and predecessors) and other regulatory boards. Don’s cases have influenced the evolution of expropriation law in Alberta but many of his best results were achieved through negotiation and agreement. He takes a problem-solving approach, utilizing decades of experience, in-depth knowledge of the law, intense listening, strong advocacy and respect for all at the table.
More recently, Don has utilized his litigation and negotiation skills and experience with additional Harvard Law School training to branch into the world of Alternative Dispute Resolution (ADR). Having participated in many successful mediations and arbitrations on behalf of clients, he now conducts them. His arbitration cases have ranged from First Nation election appeals to civil disputes. They’ve been similarly wide ranging on the mediation side. Notably, the Province of Alberta engaged him to mediate a multi-stakeholder review of the Occupational Health and Safety Code. The subsequent report showed unanimity was reached among the diverse stakeholders in almost all the 300 code sections considered.
Don has published and presented on many topics, including ADR, expropriation, land use, taxation and general law. He’s a member of the Alberta Expropriation Association, having served twice as president, and is a regular speaker at its annual conferences.
Don has been involved with many community organizations, including the Seniors Association of Greater Edmonton (SAGE), Habitat for Humanity, Kinsmen and others. His Habitat for Humanity efforts included co-chairing the funding and organization of a build in the name of the late Chief Justice William Sinclair. He’s an avid road cyclist, a certified cross-country and downhill ski instructor, an amateur violinist, hobbyist woodworker and landscaper, and proud grandparent to seven extraordinary granddaughters.
